FNSE No. 2 (SAD180/2017)

First Nations of the South East No. 2 Native Title Claim was filed on 7 July 2017 and was not accepted for registered native title claim. The named applicants are: Andrew Birtwhistle Smith, Robyn Campbell, Bruce Hammond, Myrtle (Penny) Bonney, Cheryle Saunders, Darren Perry, Mark Lovett, Chris Hartman, Gwenda Owen, Jean Pinkie, Michelle Jacquelin Furr, Kingsley A’hang.

FNSE No. 2 wholly overlaps the lower part of the Ngarrindjeri native title claim (Part B).

As there is an overlap, a process is convened by the Court to resolve each groups claims to the area. That process includes the provision of information in the form of connection reports and also holding mediation meetings between FNSE No. 2 and Ngarrindjeri. A mediated outcome was reached in March 2018, which required consideration by the State. The State’s response has meant that further anthropological information has needed to be collected and provided. Consideration of that further information, and a further mediation is scheduled for the beginning of 2020.

First Nations of the South East No. 1 Native Title Claim was filed on 4 August 2017 and was accepted for registered native title claim. The named applicants are: Andrew Birtwhistle Smith, Robyn Campbell, Bruce Hammond, Myrtle (Penny) Bonney, Cheryle Saunders, Darren Perry, Mark Lovett, Chris Hartman, Gwenda Owen, Jean Pinkie, Michelle Jacquelin Furr, Kingsley A’hang.

In relation to FNSE No. 1, it is not overlapped, and the parties (the State and the Applicant) have been following a process to see if a consent determination is possible in this claim. That includes providing anthropological evidence to the State and responding to any issues that arise in response to that evidence. Once the State has considered all the information (currently proposed to occur in January 2020), we will know the State’s view on connection.
